Bank-Owned & Power of Sale Properties in Ontario: What Buyers Should Know

In Ontario, when a homeowner falls behind on their mortgage, the property is usually sold through a process called Power of Sale rather than a US-style bank foreclosure. Power of Sale generally proceeds without a court action: the lender is authorized to sell the home to recover what is owed, and any surplus is returned to the homeowner only after sale expenses, the mortgage debt, and any other claims with legal priority have been paid. True foreclosure, where the lender takes full ownership of the property, is much less common in Ontario and generally requires a separate court process.

There is no single official "bank foreclosure list" and no centralized bank-owned property database in Canada. Banks do not publish their own public listings of these homes. Power of Sale properties are typically marketed through MLS, the same way as any other resale home, by a licensed real estate brokerage. Be cautious of anyone claiming to offer a private or secret list outside of MLS.
